1. Acceptance of Terms
By accessing or using Hawala AI, including our website, mobile application, and related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. We may update these terms from time to time, and continued use after changes constitutes acceptance of the updated terms.
2. Eligibility
To use Hawala AI, you must:
• Be at least 18 years of age. • Have legal capacity to enter into binding agreements. • Provide accurate, current, and complete information during registration. • Be a resident of Libya or authorized to use financial services in Libya. • Not be prohibited from using our services under applicable laws.
3. Account Registration
When you create an account with Hawala AI:
• You must provide truthful and accurate information. • You may only create one account per individual. • You are responsible for maintaining the confidentiality of your credentials. • You must notify us immediately of any unauthorized access. • You are responsible for all activities that occur under your account. • We reserve the right to verify your identity at any time.
4. Your Responsibilities
As a user, you agree to:
• Keep your PIN, password, and OTP codes confidential at all times. • Never share your account credentials with anyone, including agents. • Verify all transaction details before confirming. • Report any suspicious activity or unauthorized transactions immediately. • Comply with all applicable Libyan laws and regulations. • Use the service only for lawful purposes.
5. Prohibited Activities
You may NOT use Hawala AI for:
• Money laundering or terrorist financing. • Fraud, deception, or any illegal activity. • Transactions involving prohibited goods or services. • Circumventing transaction limits or security controls. • Creating multiple accounts to abuse the service. • Reverse engineering or hacking attempts. • Harassment or abuse of other users, agents, or staff. • Any activity that violates Libyan law or international sanctions.
Violation of these prohibitions may result in immediate account termination and legal action.
6. Service Description
Hawala AI provides a digital technology platform that enables:
• Digital balance transfers between users. • Cash deposits and withdrawals through certified agents. • Digital deposits via DPAY and supported Libyan banks. • Business payroll management for organizations. • Related support services.
We operate as a technology service provider integrated with DPAY's licensed payment infrastructure. We are not a bank, financial institution, or money transmitter.
7. Fees and Charges
Our fee structure is transparent:
• Account creation is free. • User-to-user transfers may include a small service fee, displayed before confirmation. • Business payroll services include a percentage-based fee. • Digital deposit fees are set by DPAY and displayed at checkout. • Agent transactions may include agent service fees.
All fees are shown clearly before you confirm any transaction. We reserve the right to modify our fee structure with prior notice.
8. Transaction Limits
For security and compliance, we apply transaction limits:
• Daily and monthly transfer limits apply to all accounts. • Limits may vary based on account verification level. • Higher limits may require additional identity verification. • We reserve the right to adjust limits based on risk assessment. • Limits are subject to Libyan regulatory requirements.
9. Account Suspension and Termination
We reserve the right to suspend, restrict, or terminate your account at our sole discretion if:
• You violate these Terms of Service. • We detect suspicious or fraudulent activity. • Required by law or regulatory authorities. • You provide false or misleading information. • Your account is inactive for an extended period.
We may take such action without prior notice. You may also close your account at any time by contacting support.
10. Disclaimers
Hawala AI is provided 'AS IS' and 'AS AVAILABLE' without warranties of any kind. We do not guarantee:
• Uninterrupted or error-free service. • Specific results from using our services. • Compatibility with all devices or networks. • The accuracy of information provided by third parties.
You use the service at your own risk. We disclaim all warranties to the maximum extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by Libyan law, Hawala AI shall not be liable for:
• Indirect, incidental, or consequential damages. • Loss of profits, data, or business opportunities. • Damages arising from third-party services (DPAY, banks, agents). • Service interruptions due to factors beyond our control. • Unauthorized access caused by user negligence.
Our total liability shall not exceed the fees you paid in the three months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Hawala AI, its founders, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
• Your use or misuse of the service. • Your violation of these terms. • Your violation of any law or third-party rights. • Disputes between you and other users.
13. Governing Law and Disputes
These Terms of Service are governed by the laws of Libya. Any disputes arising from your use of Hawala AI shall be:
• First addressed through good-faith communication with our support team. • If unresolved, subject to the exclusive jurisdiction of Libyan courts. • Resolved according to applicable Libyan financial and consumer protection laws.
